These Terms and Conditions (“Terms”) govern the purchase and use of portrait services and related products offered by The Remembered Story. Please read them carefully before purchasing a portrait experience or submitting materials for a commissioned portrait.
By purchasing a portrait experience or affirmatively agreeing to these Terms during the submission or ordering process, you acknowledge that you have read, understood, and agreed to these Terms.
1. Our Portrait Experience
The Remembered Story creates personalized commissioned artwork inspired by the photographs, memories, stories, people, places, passions, dreams, and other meaningful details shared by our customers.
Our portraits are artistic interpretations. They are not intended to be exact photographic reproductions or literal representations of every memory, place, event, or detail provided.
As part of the creative process, we may thoughtfully combine or interpret elements from different photographs, memories, locations, time periods, or symbolic details to create a cohesive visual story.
The customer’s story and source materials help guide the creative process, but artistic decisions regarding composition, placement, scale, lighting, background, symbolism, and other visual elements may be made as part of the portrait creation process.
2. Customer-Provided Photographs, Stories & Materials
You may provide photographs, written stories, memories, names, dates, locations, and other materials to help us understand and create the portrait you commission.
By providing these materials, you represent that you own them or have the appropriate rights, authority, or permission to provide them to The Remembered Story for use in creating your commissioned artwork.
You grant The Remembered Story permission to use, reproduce, crop, combine, adapt, and artistically interpret the materials you provide as reasonably necessary to create, review, revise, and deliver your commissioned portrait and related materials.
You are responsible for reviewing the names, dates, photographs, and other factual information you submit and for notifying us promptly if you discover an error.
Providing materials for the creation of your portrait does not automatically give The Remembered Story permission to publicly display your photographs, personal stories, or finished commissioned portrait for advertising, social media, portfolio, or promotional purposes. Any such use will require separate appropriate permission.
3. Artistic Interpretation & Symbolic Elements
The Remembered Story creates commissioned artwork through artistic interpretation. Your portrait may thoughtfully combine photographs, memories, meaningful places, relationships, passions, traditions, dreams, and symbolic elements into one cohesive visual story.
Certain elements may be represented symbolically rather than literally. For example, a meaningful place, hope, dream, or memory may be incorporated in a way that reflects its significance without suggesting that a particular event actually occurred.
Not every photograph, memory, person, object, or detail you provide will necessarily appear in the finished portrait. We use the information you share to identify the elements that best support the overall story, composition, and emotional intent of the artwork.
If there is a person, detail, memory, symbol, or subject that you do not want represented in the portrait, please identify that information during the storytelling and review process.
Our goal is to create artwork that feels personal, recognizable, and true to the story you have entrusted to us while preserving the artistic integrity of the finished portrait.
4. Portrait Review, Revisions & Approval
You will have an opportunity to review your portrait before it is considered final. This review is intended to confirm that the portrait feels recognizable, personal, and aligned with the story and materials you provided.
If thoughtful refinements are needed, you may request changes in accordance with the revision terms included with your portrait experience. The number and scope of revisions available may vary depending on the portrait experience or package purchased.
Revision requests should focus on reasonable refinements to the commissioned portrait. Requests that substantially change the original story, creative direction, composition, subjects, or source materials after creation has begun may require additional time and may result in additional charges. We will communicate with you before proceeding with any work that would result in an additional charge.
Once you provide final approval, the portrait will be considered complete. Changes requested after final approval may be treated as additional commissioned work and may be subject to additional fees.
Because commissioned artwork is created specifically for you, artistic differences that are consistent with the information, photographs, creative direction, and artistic interpretation described in these Terms are not necessarily considered defects.
5. Pricing, Payments & Additional Charges
Prices for portrait experiences, products, and optional services will be presented at the time of purchase or otherwise communicated to you before your order is confirmed.
Payment terms may vary depending on the portrait experience selected. Any required deposit, initial payment, remaining balance, or other payment schedule will be disclosed before purchase.
Work may not begin until any required initial payment or deposit has been received.
Requests that fall outside the scope of the portrait experience originally purchased—including substantial changes to the approved creative direction, additional subjects, extensive revisions, or other added services—may require an additional fee.
We will communicate any additional charges to you before performing work that would result in an additional fee.
Applicable taxes, shipping charges, or other costs associated with physical products may be added where required and will be disclosed when applicable.
6. Cancellations, Refunds & Custom Artwork
Each portrait created by The Remembered Story is personalized and commissioned specifically for the customer based on the photographs, stories, memories, and other materials provided.
If you need to cancel your order, please contact us as soon as possible. Any refund or cancellation eligibility may depend on how far your portrait has progressed and whether creative work has already begun.
Once personalized creative work has begun, some or all payments may become non-refundable to account for the time and work already performed. Any applicable cancellation or refund terms will be communicated as part of your portrait experience.
If The Remembered Story is unable to complete your commissioned portrait, we will communicate with you regarding appropriate next steps, which may include a refund of amounts paid for work that cannot be completed.
Physical products that arrive damaged or contain a production error should be reported to us promptly so we can review the issue and determine an appropriate resolution.
Nothing in these Terms is intended to limit any rights or remedies that cannot legally be limited under applicable law.
7. Intellectual Property & Ownership
You retain any rights you may have in the original photographs, stories, written materials, and other content you provide to The Remembered Story. Providing those materials does not transfer ownership of your original materials to us.
Unless otherwise agreed in writing, The Remembered Story retains, to the extent permitted by applicable law, the intellectual property rights associated with the original creative work, design, composition, and artistic elements developed as part of the commissioned portrait.
Upon full payment, you receive the right to display and enjoy the final portrait for your personal, non-commercial use, including displaying it in your home and sharing images of your portrait with family and friends.
Unless separately authorized in writing, the portrait may not be reproduced or used for commercial purposes, resale, merchandise, advertising, branding, or other commercial applications.
Your purchase of a commissioned portrait does not automatically grant The Remembered Story permission to publicly use your photographs, personal stories, or finished portrait for marketing, advertising, social media, portfolio displays, or promotional purposes. Any such use will require separate appropriate permission.
Nothing in these Terms transfers to The Remembered Story any copyright or other intellectual property rights in third-party materials that you provide.
8. Delivery, Digital Files & Physical Products
Estimated completion and delivery times may vary depending on the portrait experience selected, the complexity of the artwork, the responsiveness of the customer during the review process, and whether physical products are included.
Any estimated completion or delivery date is an estimate rather than a guarantee unless we expressly agree otherwise in writing.
Digital files, when included with your portrait experience, will be delivered using the method communicated to you during the order process. The size, format, resolution, and permitted use of digital files may vary depending on the portrait experience purchased.
Physical products may be produced or shipped through third-party production and delivery providers. Shipping times may therefore vary and may be affected by circumstances outside our reasonable control.
Please review physical products promptly after delivery. If your portrait or other physical product arrives damaged, contains a production defect, or does not match the approved order specifications, contact us promptly and provide photographs of the issue so that we can evaluate an appropriate resolution.
The Remembered Story is not responsible for delays or delivery problems resulting from inaccurate or incomplete shipping information provided by the customer.
9. Customer Communications & Responsibilities
You are responsible for providing accurate contact information and for keeping your email address and other relevant information current throughout the portrait process.
We may contact you to request clarification, additional photographs or information, portrait feedback, approval, payment, shipping information, or other details reasonably necessary to complete your order.
Timely responses help us keep your portrait experience moving forward. If we are unable to proceed because we are waiting for information, materials, feedback, approval, or payment from you, the estimated completion timeline may be adjusted accordingly.
You are responsible for carefully reviewing information you provide, including names, dates, spelling, relationships, and other factual details. Please notify us as soon as possible if you discover an error.
You are also responsible for reviewing your portrait during the approval process and communicating any requested refinements before providing final approval.
Communications regarding your portrait may be sent electronically, including by email or through other communication methods used as part of your customer experience.
10. Privacy & Personal Information
The Remembered Story respects the personal nature of the photographs, memories, stories, and other information you choose to share with us.
Our collection, use, storage, and handling of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.
By using our website, submitting information through our storytelling experience, or purchasing our services, you acknowledge that you have had an opportunity to review our Privacy Policy.
We encourage you to review the Privacy Policy before submitting photographs, stories, or other personal information.
Where appropriate, links to our Privacy Policy will be made available through our website and customer experience.
11. Limitation of Liability & Disclaimer
The Remembered Story strives to provide a thoughtful, high-quality portrait experience based on the photographs, stories, memories, and other information you provide.
Because commissioned artwork involves artistic interpretation, individual perceptions of artistic style, symbolism, composition, color, and other creative elements may vary. We do not guarantee that every artistic element will match a customer’s subjective expectations.
To the fullest extent permitted by applicable law, The Remembered Story will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of our website, services, or commissioned artwork.
To the fullest extent permitted by applicable law, our total liability arising from a particular commissioned portrait or service will not exceed the amount you paid to The Remembered Story for that portrait or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
12. Events Beyond Our Control
The Remembered Story will make reasonable efforts to provide services and deliver commissioned artwork within the estimated timeframes communicated to you.
However, delays or interruptions may occasionally occur because of circumstances beyond our reasonable control, including severe weather, natural disasters, power or internet outages, technology or platform disruptions, shipping or carrier delays, production vendor interruptions, supply shortages, or other unexpected events.
If such circumstances materially affect your portrait experience or delivery, we will make reasonable efforts to communicate with you and resume or complete the affected services as soon as reasonably practical.
The Remembered Story will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control, to the extent permitted by applicable law.
13. Governing Law & Disputes
These Terms and any dispute arising from or relating to your purchase or use of The Remembered Story’s services will be governed by the laws of the State of Texas, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Before beginning formal legal proceedings, we encourage you to contact us so that we have an opportunity to understand the concern and work toward a reasonable resolution.
Any legal rights or remedies available to you under applicable law remain subject to any limitations or requirements that may lawfully apply.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, business practices, portrait experiences, or applicable legal requirements.
When changes are made, we will update the “Last Updated” date at the top of this page.
The Terms applicable to a commissioned portrait will generally be the version presented or made available to you when you purchase or submit your order, unless a change is required by applicable law or you agree to updated terms.
